Terms of Service
These terms apply to bookings made with Kingsley Visuals (Si Winter, sole trader, Kent, United Kingdom) for photography, videography or related services.
Booking and confirmation
A booking is confirmed once: (a) I have sent you a written quote, (b) you have accepted the quote in writing (email is fine), and (c) any deposit has been received in cleared funds.
Until those three things have happened, the date is not held and remains available to other clients.
Deposits and payment
Bookings typically require a non-refundable deposit of 25% of the total quoted fee to secure the date. This is confirmed in your written quote.
The balance is due within 14 days of final delivery, unless an alternative schedule is agreed in writing.
Payment is by bank transfer or another method agreed at the time of quoting. Card payments may be available via my payment provider on request.
Cancellation and rescheduling
If you cancel a confirmed booking, the deposit is non-refundable.
If you cancel within 14 days of the booked date, the full quoted fee may also be payable, depending on whether I am able to rebook the date.
If you need to reschedule, I'll do my best to find a mutually workable alternative date at no extra charge, subject to availability.
If I have to cancel due to illness or circumstances beyond my control, I will refund any deposit paid in full and, where possible, recommend a trusted alternative photographer.
Travel
Travel within Kent and to most of London is included in standard quotes. Travel further afield is added to the quote and disclosed before booking.
Delivery
Delivery times are set out in your written quote. Typical timelines are: previews within a few days, final edited galleries within one to two weeks for performance coverage, and within four weeks for larger productions.
Galleries are delivered via Pic-Time at galleries.kingsleyvisuals.co.uk as a secure online gallery, accessible by the booking client. Where applicable, parent galleries can be set up at the time of delivery.
Image licensing and usage
Copyright in all photographs and video remains with Kingsley Visuals (Si Winter) at all times.
By booking, the client receives a personal-use licence to view, share and print the delivered images. Schools and production companies receive a non-exclusive licence to use the delivered images for their own marketing, social media, programmes and websites.
For wider commercial use (for example third-party advertising, paid press placements, or large-scale print campaigns), please contact me for an extended licence.
I retain the right to use a selection of delivered images and footage for my own portfolio, social media and promotional materials, unless explicitly agreed otherwise in writing prior to the shoot.
Print and digital sales
Where parent galleries or public sales are enabled, print and digital products are fulfilled by Pic-Time and its print partners. Their terms apply to the order, dispatch and any returns.
Children
I take particular care when photographing children. I rely on the booking organisation (school, dance company, production) to have obtained the necessary parental or guardian consents before the shoot. If consent has not been given for an individual child, please tell me before the shoot and I will not photograph them.
Equipment and force majeure
I use professional, well-maintained equipment with backups. In the very unlikely event of total equipment failure or other force majeure (illness, accident, public emergencies) preventing me from delivering the booked service, my liability is limited to a refund of any deposit paid.
I am not liable for indirect or consequential losses including loss of profits, opportunities, or third-party costs.
Confidentiality
I treat all information about my clients, their events and their guests as confidential and will not share it without consent, except where necessary to deliver the service or as required by law.
Governing law
These terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
